July 2008 Tip from an Appellate Practitioner
Resist the temptation to respond in kind to snide remarks or “cute” cultural references included in the opposing brief. For example, when faced with a sarcastic, footnoted reference to the Wizard of Oz, draft your witty retort and then delete it. You will feel better, your brief will be better, and the Court will surely appreciate your restraint.”
